UNTANGLING THE PREEMPTION DOCTRINE IN TOBACCO CONTROL
They don’t like being hindered for the Tobacco 21 movement.
In case you’re unaware, I want to be very clear of my position on Tobacco 21. 18 year olds in the United States are LEGAL adults. Period.
The “Tobacco 21” movement (in most cases) takes away both the legal right of an adult to choose to smoke and it bundles in restricting vaping products for 18-20 year olds as well.

“Preemption can be a thorny issue when it comes to assessing a local government’s ability to adopt tobacco control measures. Preemption arises in different forms, and a locality’s ability to address tobacco may be preempted by laws both within and outside tobacco-specific legislation.”

I call out brilliance as I see it:

Speaking of nicotine…

The University of Pennsylvania and Johns Hopkins University joined in an experiment…

I’ll paste the fun stuff, you can read the whole article below:

I assume no humans were harmed or judged by how quickly they buried marbles and ate food. BOLD, underlining and italics are my emphasis… and joy to do.

“Obviously, humans are not exactly like mice, and these early findings can’t be applied to us.”

Limitations

The study does suggest that metformin may ease some nicotine withdrawal symptoms, due to its action on the AMPK chemical pathway in the brain. However, this has so far been tested only in mice, which were given nicotine via an implanted pump and injected with metformin – the drug is taken orally in humans – with withdrawal symptoms judged by how quickly they buried marbles and ate food.

While there are similarities in many of our biological pathways, humans are obviously not identical to mice, and these results can’t be taken to mean that metformin would be a suitable or appropriate treatment to help people stop smoking.

Metformin May Help With Nicotine Withdrawal Symptoms

For Smokers Trying to Quit, Information Could Be Key

Ya think?

For Smokers Trying to Quit, Information Could Be Key

Dr. Attila Danko: How Tobacco Control Saved Big Tobacco

YES.

Dr. Attila Danko: How Tobacco Control Saved Big Tobacco

U.S.A. ONLY:

I know we’re a community. I’ve participated in surveys worldwide. I conducted one myself. This one is United States participants only and designed specifically with F.D.A. guidelines.

Are you in the United States?

Did you fill out the survey for flavors yet?

NIDA’s E-Cigarette

Well… how about that.

Tobacco Alternative Gums Market: Sales Volume, Revenue and Growth Rate Forecast

The usual suspects:

“One of the important growth factors for the global tobacco alternative gums market is the increasing price of cigarettes.”

Tobacco Alternative Gums Market: Sales Volume, Revenue and Growth Rate Forecast

Huh.

Explaining the discontinuation of a non-tobacco nicotine project at Philip Morris: obstacles to innovation.

Imagine if you can, in 1994 there was something developed called a “Capillary Aerosol Generator” (CAG)… and guess what…

So, why was CAG development ultimately abandoned? During his deposition and witness statement, PM’s expert witness and former employee, Peter Lipowicz, mentions that technological barriers, consumer acceptance, and an US Food and Drug Administration (FDA) approach that disadvantaged non-tobacco nicotine products were chiey responsible…
He says that CAG development was less attractive due to legal challenges about the addictiveness of nicotine and fears about overarching tobacco industry regulation, more so than regulatory barriers specic to non-tobacco cigarettes…

Explaining the discontinuation of a non-tobacco nicotine project at Philip Morris: obstacles to innovation

Nicotine “addiction”

Bear with me…. and my favorite subject…

Because of the tweet from “Industry Documents” showing Philip Morris had tried a device in 1994 containing this link about a “Capillary Aerosol Generator” (CAG) above…

What caught my eye in that article “He says that CAG development was less attractive due to legal challenges about the addictiveness of nicotine“….and that legal challenges of nicotine – of course -caught my attention… so I looked up “legal challenges nicotine 1994” on Google…  because I’m an inquisitive and persistant bastard…

Which led me to this from 2001, buried :

“The effects of nicotine on the brain are similar to those of sugar, salt, exercise, and other harmless substances and events”

“There are so many findings that conflict so starkly with the view that nicotine is addictive that it increasingly appears that adhering to the nicotine addiction thesis is only defensible on extra-scientific grounds.”

Public Health Implications of Raising the Minimum Age of Legal Access to Tobacco Products

“conclusions about the likely effect of raising the minimum age to 19, 21, and 25 years on tobacco use initiation.”

E-cigarettes and the obsolescence of combustion

“…substantial proportions of the population wrongly believe that e-cigarettes are as dangerous as combustible cigarettes…. Unfavorable press coverage, negative campaigns by e-cigarette opponents, and lack of training of health professionals may explain this situation.”

E-cigarettes and the obsolescence of combustion

Topeka “Tobacco 21” Ordinance Turned Down by Judge

Adult choices are adult choices. I wonder why the “Tobacco 21” movement isn’t going state by state rather than each individual local city/town… 50 times rather than hundreds of times… publicity – public opinion – wasting valuable time for those opposed?

A #CrankyOldBroad whispered in my ear – if they get the towns, they can manipulate the states… and most – if not all – of these “Tobacco 21” moments are including e-cigarettes… take all the time you need with that…… Either way, Topeka said “NO“.

Reject Proposed 75% Tax on NJ Vapor Industry

Directly related:

Have you ever wondered WHY they wanted to classify nicotine as “tobacco”? Because smokers paid that tax, not tobacco companies. Now, not that I like smokers still paying tax, I DON’T. Not any more than liking people NOT smoking paying the tax.

However, because they can impose tobacco taxes on a NON-tobacco product like e-liquid…. (and tops, and batteries according to National Tobacco Day)

Nothing says #KeepSmokingWeNeedTheMoney, #PonziScheme and “return on investment” like bonds that “were based on assumptions that cigarette smoking declines would not exceed 4 percent annually.”

David was someone who emailed me early on while conducting my survey (2014) explaining I had nicotine strength (and addiction) all wrong… I didn’t have any higher than 24… he explained strengths went higher…much higher. He explained why.

Californian Catastrophe

In the world of funny, this is sad, and this is funny. Not because I was one mentioned within –  because it shows the power of a headline and the lack of intelligence from anyone immediately involved taking it upon themselves to jump on the stupidity bandwagon… and this is why we can’t have nice things.

It is also why, when I as a consumer, do not understand something, I ask someone smarter than I am to explain it. Of course, that practice is evidently not a familiar thing to do among professionals….they just toss it out and… well, I’ve taken up way too much of your time:

Please, tell the FDA what you think.

I don’t know how pissed off I am after seeing this article. I’ve said it before, I’ll say it again. “If “children” are *already smoking, they’re *smokers regardless of age.”

Controlled or not, it is ok to fail its study to test “safety and effectiveness” using 12-17-year-old kids with a *known* dangerous and previously BLACK BOXED drug.

Evidently. If anyone has the actual study… I’d like to read it and have someone explain it to me properly.

Pfizer’s quit-smoking Chantix fails study in adolescent smokers

This is the “pisses me off” part of the news, part II.

If you’re not on Twitter, I suggest you join. Below is just an excerpt of Marita Hefler explaing she has “qualitative” expertise in response to Jenni Biebert. The obvious part about being qualitative is the disregard for consumers throughout the thread, despite the response below.

She talks TO smokers (not with them, I assume) and for the record believes e-cigs “have a limited role” in reducing smoking in Australia. The louder the scream test, the more she  – and those like her – expose their true mission.

Speaking of missions, here’s that ball squeezing study Colin was tweeting about:

Prevalence of current cigarette smoking among adults

US adult smoking rates are below 15% for the first time *ever* in history at 14.1%

You’re smart people…. (you’re welcome.)

Think about it…….. smoking rates are the lowest in history.

Don’t worry yourselves about “transparency”  by the government(s) with *wink* science.

There would NEVER be *wink* a black market for cigarettes.

Meanwhile, Dr. Gottlieb, with growing support of political “health” front groups – are working feverishly to *encourage* “lower nicotine” cigarettes… while trying to all but decimate e-cigarettes into oblivion.

Ending Global Confusion

I’ll need about eight minutes more of your time.

A loss.

Some of us, over the years, have met each other, helped each other, counseled one another. We are a community that impact each other on a grand scale. Within a community, we fight (sometimes within, often for each other). Within that global community, on occasion there are losses of what we consider casual relationships online right down to knowing people as friends – well beyond a tweet or facebook exchange, treat each other as family.

Personally, I am reminded of finally meeting Ann at the premiere of A Billion Lives in 2016. We lost her last year. She was one who impacted so many behind the scenes as she did online. Karen Lee a.k.a Fiamma Palermo from 2015 who used the #ImProof hashtag, Alice Dalton of the Vape Help & Vape Safe Facebook group who was always cheerful and helpful to everyone.

Another via James in Ohio this week was Keith Ross, Sr.

I ask you to think about their contributions… and YOUR contribution to what has changed your life. Start a blog, tweet, join groups, make some NOISE. Imagine the impact you can have on others and the future with this fight. Often I am inspired by others just from a statement in a group or a tweet. Learn from each other. Stop asking what can you do – start doing.

FDA Creates Cigarette Confusion- Calls For Science To Back Up Policy

It is the middle ground between light and shadow, between science and superstition, and it lies between the pit of man’s fears and the summit of his knowledge. This is the dimension of imagination.

It is an area which we call The #KeepSmokingWeNeedTheMoney Zone.

FDA Creates Cigarette Confusion- Calls For Science To Back Up Policy

This isn’t like “lowering nicotine” hasn’t been tried before…

from 1989:

“The ultra-low-nicotine cigarette is the latest entry in an increasingly feverish race among tobacco manufacturers to stop a decline of 2 percent a year in cigarette consumption in the United States. (Sound familiar?)

”It’s a pretty common, patented process that we’re all aware of,” said Douglas Keeney, chairman of C. A. Blockers. He said his company had experimented with eliminating nicotine, but had abandoned it as being too slow and unwieldy.”

Low-Nicotine Cigarette for Philip Morris

And here if necessary to continue the very silly point….

Very Low Nicotine Cigarettes

Lowering nicotine in cigarettes “bonus section”.

I don’t think I’ve ever given out a bonus on my blog… so there’s that. I take my position blogging as a consumer seriously. While I appreciate my regular readers, I also want smokers who are curious (or afraid) to find answers. I ask questions; how will a new idea to reduce smoking and dangers from inhaling smoke (like IQOS above) by choice “work”? Are they better? Are they the same?

Along those lines, same goes with the ever-popular “reduced nicotine” claim.

As far as “other chemicals go”….. “experts” (a term I’ve finally come to admit is rather funny) aren’t saying a reduction of anything but nicotineif they are making that claim, PLEASE let me know.

Moving on – You knew this was coming. So – I have to ask. This morning, Cliff Doug – “VP for Tobacco Control, American Cancer Society, and faculty, University of Michigan School of Public Health” answered my 1st question “What exactly will be different from 1989?”.

Being a smartass with his response, which I do appreciate, I asked the question again… (***politely for the record***) with obvious repercussions if he answered. We both knew that…..

Cliff Douglass himself recently unblocked us on Twitter – for some strange reason – maybe he likes a challenge. Challenge accepted.

I wonder if he’s calling someone? Is he unavailable suddenly for comment? Must be something like that. He left me standing on the edge of a ….

Cliff simply…..hasn’t answered yet. I won’t hold my breath, but the sound of silence is deafening.

After all, all he was just tweeting about is what would have a dramatic impact on public health.

I’ll blog about that this week along with David Goerlitz and more… you’ve been warned.

I’ve covered this before…at length with Meg about pounding sand here.

See here George – what we’re going to do is get volunteers to act like the public and get them to go in to this convention with backpacks with a hidden an air sampling pump.

We’ll do it discreetly and try to be all sciency. Boy, I sure hope we can get away with it…. then, we’ll use those backpacks to stash all that grant money!

I’ll call this one “The Emperor wears no bias”.

These are some of the people…..

I purposely haven’t found myself in or around a vaping convention of any kind… I still have never been to one. That subject is for another time.

I did, however, take a trip up to Columbus, Ohio last weekend. On purpose.

20180224_140545

A long overdue meet with a few stellar people at the Vapor Station (Hilliard, Ohio) with (among others) James Jarvis (& his wife) of the Ohio Vapor Trade Association, FIG Ramsey who I’ve adored since forever… and the brain behind Gonzo GivesMike Peterson of 2 Stone Vaping, and finally, a man I’ve admired and stalked followed since December of 2014, and met briefly after the premiere of A Billion Lives, David Goerlitz.

If these are the people I’m surrounded by and engaging with at a vaping convention, I’ll be at every single one I can get to. These are some of the people who are making some noise. These are some of the people who are paying attention. These are some of the people around the country who are #LoudER. These are some of the people who are passionate, caring and attentive. These are some of the people making the world a better place. These are just some of the people who DO something.

Surrounding myself with those smarter than I – is my goal, and that was achieved.

Here’s me just moments (or an hour or so) after I touched a Fig.

What We Know About E-Cigarettes: Data and Science Is Available

Are E-cigarettes Harmful

What We Know About E-Cigarettes

What We Know About E-cigarettes is clear. Data is easily found. Science is piling up. The Food and Drug Administration released their “Every Try Counts” campaign. I looked for the e-cigarette section on the link provided ~ because I’m a curious soul, and found the section “What We Know About E-Cigarettes”.

I’ve completed my meta-analysis and the data shows here that “Every Try Counts” only eludes to every try counting. The propaganda found on the website does not support e-cigarettes as a “try”. In fact, It looks like I may have found the “what we know about e-cigarettes” master draft journalists are using as a coloring contest fill in the blank exercise. By adding sentences, sprinkled opinions, various lies and fodder between the text and adding an ever catchy title with scary words for a click-bait title , ~voila~ they have a full article of “we just don’t know” here.

What should you know about e-cigarettes

If you are are a journalist. If you are a professional. If you are in any capacity in the medical field, feel free to reference my sentiments on the challenges of e-cigarettes public health experts face daily, here.
If you are a person with a prestigious title similar to “politician, front group liaison, expert, media contact”, etc.) and have an uncontrollable urge to look stupid, please, consider not doing that.
Science and data show e-cigs are a safer option and cessation rates are high according to available government research.

Below are my edits in bold, italics, etc, and with links below each paragraph to data and science.

Paragraph one:

E-cigarettes are officially known as electronic nicotine delivery systems (ENDS). They are more commonly called e-cigarettes, e-cigs, e-hookah, or vapes. You may have seen ads or stories on the internet that say e-cigarettes are a safe safER choice to help smokers quit choose to switch from smoking. There isn’t enough is plenty of scientific evidence to say if this is true or not. Opinion alert: Here’s what doctors and researchers do know right now.

What we know about e-cigarette research

Research: Here, here and here. Oh, here, here, here and here. That should get you started.

Paragraph two:

We already know this: E-cigs work by heating a liquid that may or may not has have nicotine and other chemicals in it. Heating the liquid turns it into a vapor. That’s what the user inhales and exhales. Some research shows that this vapor includes chemicals that are known to be less harmful. Scientists are studying the health effects of using e-cigarettes. New information is coming in, but they don’t have the answers yet. but is being all but ignored.

What we know about withholding information:

There’s Withholding differential risk information. Information is available here, and “Lower Carcinogen Levels” here, scary science here, and “Harm reduction in COPD smokers who switch” here.

Paragraph three:
Although FDA is working to regulateregulating e-cigarettes to restrict, tax and ban these devices,no more innovation can be achieved, currently they are not regulated. That means the makers of e-cigs don’t have to say what is in them. There are ways to know is no way to know exactly what chemicals are in e-cigarettes, it’s called science or how much are in these products.

What we know about regulations

National Tobacco Day is covered here.

Paragraph four:

We do know that some, not all e-cigs contain nicotine. Nicotine is by proof of assertion, what you believe is addictive what makes tobacco addictive. Nicotine can (may, could, might) also affect how the brain develops. Because childhood and teen years are times of important brain development, the nicotine in tobacco and e-cigs is believed to be especially bad for children and teens.

What we know about nicotine

Nicotine is covered here, and here with “approved” methods, proof by assertion (the addiction to saying it is addictive) is covered here, and more nicotine is here, nicotine propaganda is covered in-depth here, and by me here.

Think of the children™ is covered in-depth, where there is no such thing as a gateway here, 10 years of smoking rates are plummeting for children here, described as weak here and covered here, and very interesting points of restrictions here… my fingers are tired, but I’ll press on because it’s important.

I’ve covered gateways and nicotine addiction, here.

Paragraph five:

It’s also not very clear if e-cigs do help people quit smoking or or if  and the government, public health, tobacco control experts purposely get in the way of people quitting. Researchers are working hard to find the answers to these important questions. For now, we do not know if using e-cigs is a safER and helpful way to quit smoking, so using e-cigs is not recommended. There are other proven, safe, and effective methods for quitting smoking.

Explore the options to find a quit method that’s right for you.

What we know about helpful

There’s that pesky National Institutes of Health (NIH) and National Institute on Drug Abuse (NIDA) showing 79% success rate here.

Clarity on research misconduct happens to be here.

I can show you 7,238 answers to helpful here.

Science and data show e-cigs are a safer option and cessation rates are high according to available government research.

I typed slow, but you can bookmark this page and refer to it anytime, share it with your professional friends, and while you’re here, may I suggest if you’re writing an article or op-ed on e-cigarettes, try harder for information. Look to the left and right of this blog.

Repeat after me:

Science and data show e-cigs are a safer option and cessation rates are high according to available government research.

VapesGiving Event Aims to Raise Huge Funding Goals to help Advocacy

Instead of focusing on what “can’t” be done, consider what CAN be done. Considering what is at stake, there is NO reason #VapesGiving can’t raise millions with this movement. This is beyond overdue.

Companies, including manufacturers, are joining with multiple advocacy groups to raise what should be nothing short of millions to attain results at any and all levels.

If you are IN business and not doing “anything”, I implore you to assess this and make some noise by making a difference. If you are already, I thank you.

The verdict is in if you’re in the United States, you’re seeing tobacco companies court-ordered advertising on television for the 1st time since the 70’s. Sally Satel & Guy Bentley explain why the Feds owe the public the same courtesy.

While they mention the Centers for Disease Control and Prevention (CDC) and the Surgeon General, I can come up with a list of defendants in other parts of this blog upon request.

Long-term vaping causes no negative health results [new study]

Last week, I inadvertantly skipped this article by Jim McDonald.

“They found that the vapers had no negative health outcomes, and in fact showed results that were virtually indistinguishable from those of the non-vapers.”

Indistinguishable. This study extinguishes concerns, certainly, as to a smoker switching or dual using, and the very few and hard to find, who may take up vaping as opposed to smoking.
