Harm Reduction: Cliff Notes

I’ve been searching for quite a few years for someone louder in the tobacco control and public health sectors, for a hero. Someone to correct easily repeated disinformation and outright lies. Someone with balls. Cliff Douglas notes harm reduction with precision.

In a surprising tweet, Cliff Douglas did just that. How? He released a document titled “It is Time to Act with Integrity and End the Internecine Warfare Over E-Cigarettes” in a tweet (here) on March 4th, 2021. It’s about damn time.

In dealing with e-cigarettes, he explains the tobacco control community is “letting down tens of millions of adult smokers, their families and friends”, along with “healthcare providers, and government decision-makers.”

He calls to “pursue rational, social justice-oriented approaches to tobacco harm reduction” and later states: This is clearly a social justice issue.”

opposition to even considering positive scientific findings related to the promise of vaping for cessation and harm reduction is widely reinforced by confirmation bias“…

Crafted with direct language to his colleagues, he’s quick pointing out valid concerns for vaping products not being ‘approved’ by the Food and Drug Administration (FDA), but states the issue is “factually separate from whether these products are in fact helping a significant number of adult users quit smoking“. That’s harm reduction.

Also discussed is the rise in cigarette sales due to a massive “negative coverage on e-cigarettes” and bans on “all flavors” in e-cigarettes because of youth use (<– that’s an important link), while ignoring adults wanting to choose safer alternatives.

Not mincing words on the 2019 “Evali” fiasco, he states: “To be clear, EVALI is caused by vitamin E acetate added to illicit THC vaping products“, adding his niece returned to smoking because of the misleading headlines.

“Stop skirting the truth when it feels inconvenient”


Is this statement from Cliff Douglas too late?

I certainly hope not. During the middle of a real health crisis – the covid pandemic, politicians are distracted by pushing for a vape mail ban to restrict access to adult consumers, and because of pubic opinion of a fake ‘epidemic‘, outright flavor bans are still being pushed to ban less smoking by politicians like Senator Mitt Romney and Congressman Raja Krishnamoorthi for products children cannot legally obtain.


Blackballing – Blacklisting

With the leadership Cliff Douglas portrays, I hope to see others willing to have the courage to speak out. I say that because fear of being shunned – literally blackballed by their professional peers for explaining data, research, and science, is a thing.

I say again, blacklisting that’s a thing in the public health sector. I’ll let two examples from professionals – where they will turn, with vile contempt, on themselves…

In 2009, Dr Michael Siegel explained his experience of stepping out of line with the anti-smoking narrative:

“Importantly, only one perspective on this issue was presented to us in the trainings. There was no room for disagreement or challenge. These ideas were presented as scientific facts, not subject to debate. In fact, if we were to challenge the ideas, the implication was that we – ourselves – might be accused of working for Big Tobacco or receiving secret payoffs.”

Highly respected public health warrior, Dr. Marewa Glover, (Centre of Research Excellence, Indigenous Sovereignty & Smoking) – knows all too well how vindictive the community can be. After decades dedicating her life, well respected experience, the damage already done, she was eventually given an apology (here).

She also gave Patrick and I keen insight to fundamentalist anti-tobacco stigmatization – cynical optimists I call them, who use deliberate behavioral methods – to ‘help’ and manipulate smokers with cognitive dissonance, projecting a ‘spoiled identity’, “barbarian whipping school” style – on Smoke Free Radio last year (here).

What about employees of big, bad tobacco companies? Do they get their say? Well, personally, as much scrutiny as they’re always under, (and public health isn’t), I trust them way more than you might think.

Speaking of being under a microscope, Dr. Gilchrist, the head of Scientific and Public Communications for Philip Morris International… Her twitter says she’s an “Advocate for “better”. Science Lady” (who I admire and follow on Twitter):

I can think of countless times when others in the scientific community have been afraid to support us publicly – despite supporting our smoke-free vision and the evidence – because they feared for their reputation, job or funding if they were to do so.

Like most of my regular readers, I’ve searched for – and found – a few individuals in the public health and tobacco control sectors willing to stand up, unabashedly state facts, call out the preposterous junk science, and stop the manipulation of information about vaping products.

Then they’ve been ostracized. Who wins? Certainly those valuing their pride overrides the very public’s health they’re paid by and employed to, to “protect”.

Consumers need the truth

If less smoking “at any cost”, is the “end game”, and is their only goal, they’ve done a piss poor job of trying to convince me and millions of smokers and families looking for answer(s) buried in their constant attempts to be the “popular kid” on campus spewing contrived sociopolitical and pseudo “science”. That’s not harm reduction.

My hope is this powerful statement by Mr. Douglas encourages others in all facets of leadership roles in public health, to do the same. I’ve revised my statement: “I’m for whatever works for the informed consumer. Patch, gum, Heat Not Burn, vaping, snus, acupuncture, books, hypnosis, counseling, Hale, Juul, etc. Do I “like” them all? No. It’s not about or me, or what “I” like. What may work as a choice for a consumer is first.” That’s harm reduction.

I’ll repeat myself: If less smoking, “at any cost”, is the “end game” and is their only goal, the words in the tweet below should be used at all times. “No neighbor left behind”. That’s harm reduction.

I’ll paraphrase Skip Murray (I affectionately call her #CrankyOldBroad). None of this should be “us” against “them”. It shouldn’t be about who’s “winning”. It should be about helping one another. Period. That’s harm reduction.

Like my last blog, it’s a matter of public health, and it’s personal.

Let’s get to work, public health.

Our Voices: We, The People

I was LOOKING at the WHITE HOUSE.

Over the weekend, I took a little trip to Washington, D.C. to exercise my first amendment rights with a few friends. It’s kind of a thing, speaking my mind. Knock, knock, Mr. President.


On Friday, while I traveled to D.C., President Trump stated they’d be coming out with a “very important position on vaping” and mentioned raising the age to “21 or so”, as reported here. I saw that on the eve of what would be, in my mind, a historic showing of consumers the following afternoon. On September 11th, he’d already stated bans were coming.

It didn’t matter what I heard. The Office of Management and Budget had already cancelled appointments the week before. None of that mattered, we were already knocking on his WE, The People’s door. We were prepared to make a unified statement about our CHOICE for less harmful products remaining available.

Many had already arrived, more were on the way, and you could feel the passion.

I want to thank EVERYONE wearing those vests. They were invaluable in keeping this rally safe and smooth.

They said it couldn’t be done

Humor me: If you’d told me I was going to be in D.C. – at the White House – because I stopped smoking….. well – here I was with what I hoped to be thousands of others. Why? Because we’re adults. Because we’re consumers. And small businesses. And we’re all frustrated and angry.

We were in our nation’s capital – to have our voices heard, to exercise our rights and responsibility: “The right to freedom of association is recognized as a human right, a political right and a civil liberty” as so many had done before us.


For YEARS

We’ve listened to PHINO’s (Public Health In Name Only) lie. They’ve altered presentations. We’ve watched them conduct themselves with bias, without accountability, interpreting, manipulating, and misrepresenting “dangers” and hyperinflated youth data.

For YEARS

We’ve been completely dismissed… ignored. Preempted, with hostility. Talked down to. Talked over. Not included in the conversation. We’ve been lied to in court hearings, lied about in the press. Small businesses (and consumers) have been accused of “marketing to children“.

For YEARS…

…we’ve been called what could not be further from the truth: Addicts, Anecdotes, Bots, Impugners, Sheep, Shills, and worse. (I am kind of fond of being called a bot, though.)

For YEARS…

…despite the fact that there are plenty of examples of reasonable regulatory steps, “trusted public health experts” and non-governmental organizations quietly sit with mouths clamped shut, standing with hands open, choosing demanding (and hiding cowardly behind) Master Settlement Agreement funding, instead of putting forth effort by making an already less harmful choice for the world – better.

THOSE people hide behind the illusion of “helping”.


I’d heard “we should go to Washington” so many times, I didn’t care if there were 9 people or 90, or 900, or 9,000.


For YEARS…

we’ve watched politicians demanding (and recently invoking) bans for anything but cigarettes. We’ve watched media vultures – gnawing on every buzzword like “deaths” of unrelated, illegal products – to bring it all full circle… to regulate, restrict, tax & ban any and all forms of less harmful products, and flavors.


So yeah, I was excitedly in our nation’s capital… with a growing crowd of pissed off people fighting peacefully for freedom of choice against the threat of BANS of less harmful adult flavored products for everyone across the country, and quite possibly the world. If they could get away with this, what other abuse of power and criminal acts can non-governmental organizations and “public health ‘experts” get away with? Knock, knock, Mr. President.

NO more.


If you build it, they will come

While it may not have looked difficult for this to have been accomplished, preparations and logistics HAD to be handled. This was White House property. There was National Park Service & Secret Service to coordinate EVERYTHING with. There were all volunteer marshals for safety & logistics – and it couldn’t have been done without them in place.

The United Vapers Alliance planned & coordinated anything and everything that could have been thought of (<-video). This was not just pulling into the park with the family and having a picnic. This was the nation’s capital. Anyone or everyone “could” have been removed at any time by the National Park Service or Secret Service at their discretion – for the slightest infraction.

There were rules for everyone to follow & abide by. Restrooms were at least a ten-minute walk away. A first aid station. Assigned people for talking to the media. There were to be no bags left unattended. Permits to be obtained. We wanted to be HEARD, so stage and sound had to be rented and set up. Signs were ordered. Radios were needed. The coordination and the flow of speakers… cleanup… and leaving the park just the way we’d found it.

All we were waiting on were YOU, the people. We knew they were coming from Alaska, Georgia, Tennessee… New York… Ohio… Florida… and they were coming by the busload… some were already in the park and coordinating the days event.


Wait… Secret Service said we had to vacate the area, (we knew it could happen) because President Trump was flying out. When the Secret Service says move, you MOVE. Most went across the street to the Washington Monument.

While almost everyone waited across the street, the President flew directly OVERHEAD… so he SAW us… He must have thought – that many people must be serious if they’re willing to travel, stay, congregate, and assemble peacefully as WE, the PEOPLE, in Washington, D.C. on a cold Saturday afternoon.


“History is full of disapproval of or objection to something “someone else” didn’t like.” ~ Me.


President Trump was gone, but We, The PEOPLE, were NOT.

The Secret Service were extremely kind and held traffic for us WE, The PEOPLE to get back across Constitution Ave. Here we are streaming back into the park after the flyover.

Back to business at hand, folks – back in the park we go. We’re coming back in…and more were almost here on various buses. (One of my photos.)

YOU, the people, came.

The vast majority of us use flavors. We’ve TOLD them that. It has been submitted to the FDA. Without linking it all, authorities HAVE data.

We came to speak our collective minds. We were #LOUDER. (Thanks, Sherwin!) We are, and have been tired of being lied to, lied about, and ignored.

Speakers spoke. The crowd listened. “We Vape, We Vote“.


How many were in the crowd? I don’t know the total number in attendance at this historic event, but I know I missed finding and meeting some of you. That’s how many came. So, speculation of numbers? More than 9, more than 90, and more than 900. Hats, hoodies & sunglasses disguised (us) some of you – but I found a few… gratefully, a few, like Amanda Wheeler, found me!

I wandered around – surfing the crowd –like a bot– listening to the speakers. Taking photos, taking the moment in – still dumbfounded I was standing in eyesight of the WHITE HOUSE with thousands of others who had simply quit smoking, having to FIGHT for our rights to flavors because we didn’t quit smoking the way “they” wanted us to.

I saw familiar digital faces, some I didn’t recognize until I heard their name. I shook hands, got hugs, saw Brent Stafford from Regulator Watch covering the event. (See his site for interviews!!!)

Then, while behind the stage I heard Business Insider, Buzzfeed, CNN, Fox, NBC, NPR, and Vice (who said the rally “was relentlessly sincere“), were also there.

I said to myself and others about 5,000 times Saturday: “Holy shit, I’m in front of the White House. It’s about F’n TIME”. And just like that, harm reduction-this cause, is national news…

Whether you came or not, if you read this blog, YOU had a place here in Washington, D.C. on November 9th. YOUR consumer voice was represented. If you weren’t there, you were tweeting and flooding the switchboards (ring, ring, Mr. President) with calls to the White House.


I proudly carried this sign.

“We vape, we vote”.

What was the message? The message was “to educate the public and politicians regarding the benefits of harm reduction via vapor products, and will strongly convey that changes must be made, within the FDA, to provide an economically feasible pathway to market.” (Source) including FLAVORS.

You may ask – was this necessary?

After all, President Trump had already left for a football game. Was he listening? Did he care? I’ll answer: YES. Period.

Was this rally important?

  • Was it #LOUDER? YES.
  • Did it make an impact? YES
  • Was the timing right? I’ll get to that.
  • Did this rally change the conversation? YES.
  • Do I think we got our collective message across? Hell yes.
  • Was explaining how our voting power in swing states could change an election? Yep.
  • Was the effort and collaboration of consumers showing their faces in D.C. worth it? Hell yes.

Was it “worth it” to get national press, and for our President, the leader of the free world, explaining on Veteran’s Day, that he’d be meeting to come up with an acceptable solution in less than 48 hours after the event?

Pay attention to CASAA’s words: “...the MAIN STAKEHOLDERS in this issue are the millions of voting CONSUMERS who rely on these products.”

Abso-damn-lutely.

By any means, this isn’t over. This fight has just begun.

Consumers need small businesses, and small businesses need organizations who represent them all – to have their collective voices heard.

Two months after announcing his administration would “clear the market”- to the day, he decided he will “be meeting with representatives of the Vaping industry”.

Did this rally give pressure to change the President’s MIND or give pause to his decisions concerning our freedoms? I certainly hope so.

The world was watching.

No one had done this before.

Will this event be analyzed or criticized? Possibly, yes.

Without question, We conducted ourselves in a civilized manner – and had some of the loudest voices in the nation representing you, the people, in a civilized manner.

I have hope that if you were unable to attend this event, you tweeted, called the White House, and saw that if it can be done in Washington, D.C., it can be done anywhere in the country.

I hope it inspires and motivates you to DO that very same thing in your area, and to show up at city and state hearings. I hope it inspires you to be #louder.

Fighting for themselves, each other, you, small businesses, and future smokers who have the RIGHT to choose to switch to a less harmful alternative, with flavors of their choice…

On a personal note – I reflected quietly – with my mind racing on the drive home… about the awe-inspiring experience, realizing I’d been a part of history. I was VERY proud of us.

In hindsight, I have just one regret for November 9th… I didn’t think to call the White House to oppose a flavor ban between speakers, and invite the President to come visit us from the stage myself… of course, he’d already left for a football game.

If you’re going to Washington D.C. for this consumer rally, I hope to shake your hand. If you’re unable to attend, please know you are being represented by some of the most passionate consumers in the country who are defending your rights (and future rights of others) for keeping flavored products and less harmful alternatives on the market. Period.

History is full of people fighting for civil liberties.

The history of the United States is full of motivated people. Immigrants came to find a better life, traveling in uncomfortable conditions for a better life, seeking freedom and civil liberties…

In 1920, the 19th Amendment granted women the right to vote.

Rosa Parks sat down on a bus in 1955 to defy unjust laws saying she couldn’t.

In 1963, there was a civil rights movement called the March on Washington for Jobs and Freedom where Martin Luther King gave his iconic “I have a dream” speech.

In the 1970’s, students were gunned down here in Ohio at Kent State for protesting the bombing of Cambodia by U.S. forces.

In the 1980’s, protesting went directly to the FDA while their broken system would turn law abiding citizens, AIDS patients, into criminals.


What else will they take from Americans?

I’ve heard – since 2014 – we should go to Washington, D.C. and protest for our, and future rights to have access to less harmful alternatives. Now we are going… Like many before us, we will have our collective voices heard.

Is our cause as important as a right to vote or a right to have a seat on a bus over another? I believe it is the the exact same fight. Those same people expressed their rights, in the same way facing disapproval of, or objection to something “someone else” didn’t like. In our case, unjust laws, junk science, propaganda, and control are still being utilized to deny freedom and liberty of choice with the same disapproval and objection.

The freedom of assembly is part of our First Amendment. I plan, with a few of my friends and fellow consumers, to exercise that right in Washington, D.C. on November 9th.

WE, The People

October 1st, Columbus, Ohio Statehouse rally.

Consumers: WE, the people.

That’s YOU.

Over the past few years I’ve seen and heard variations of “we should go to Washington and hold a rally.” Well, dear fellow consumer we, the people, it is beyond time. Suddenly, when President Trump tweeted about vaping, we are IN the national spotlight.

Now is the time for we, the people to come together in one voice – and make our presence known in our nation’s capital. Millions have bravely gone before us, now it is our turn.


“Life, Liberty and the pursuit of Happiness”.

What does that mean to we, the people? As long as you’re of legal age, smoke if you like. Or don’t. To me, it means freedom of choice of a less harmful alternative to smoking.. and that includes flavors.

I’m confident American small business owners and consumers alike are familiar with the history that helped frame the foundation of the United States.

Enraged by control, taxation, tyranny, and demanding freedom – the Sons of Liberty (merchants/small business owners) decided, defiantly, to throw themselves a tea party in the Boston Harbor. They became #louder.

Before this, boycotts and smuggling – black market – tea was prominent.

Despite efforts to circumvent the movement we, the people, vaping products are removing cigarette tax revenue from the government. That’s what small businesses and consumers we, the people, are doing. This is our “Boston Tea Party”.

The United Vapers Alliance (UVA) was formed as a 501(c)(4) organization earlier this year. The sole intent is to educate the public and politicians regarding the benefits of harm reduction via vapor products, and the right to keep flavors on the market as a consumer choice.


Why:

Because the government is WRONG. Our messaging needs to be clear, simple, peaceful, and united. Consumers, we the people’s rights are being infringed, restricted, and may possibly be extinguished by government actions and policy all over the nation. The time for silence is over. The time to be heard is NOW.  For too long, we have waited for our politicians to do the right thing.  No more.

“So whether or not we choose to believe the FDA’s stated intent to entertain the re-introduction of flavored vapes at a later date, this is, at least, a de facto permanent prohibition for smaller operators.” Source

THOUSANDS of citizens like Susan Ripley (below), have created small businesses, creating jobs by investing in this life-changing technology. Now they are fighting for their rights – along with ours.

United Vapers Alliance will LOUDLY inform Congress and the FDA, that if they do NOTHING, 99% of all vape products will be removed from the market by May, 2020.  United Vapers Alliance will fight for the right to live a less harmful lifestyle and see OUR children grow. 

We are an estimated thirteen+ (13+) million strong, with families and friends who have seen the positive change that vapor products have provided.  If our politicians will not listen to our voices we, the people, then our voices will be heard at the ballot box this 2020 election.

Together, consumers will rally with ONE voice, ONE mission, ONE message, and will shake the very foundations of power in Washington D.C..

Ohio Vapor Trade Association

“And active membership is much more important than a membership with a lot of people.” ~ Nick Orlando.

The Ohio Vapor Trade Association (OHVTA) held their 2019 conference on Tuesday, May 14th, where OHVTA President James Jarvis hosted Ohio State Representative Doug Green, and Ohio State Senator John Eklund.

Along with James Jarvis, speaking at the event was Ohio Rep. Doug Green, Ohio Senator John Eklund, OHVTA Lobbyist Charlotte Hickcox , Nick Orlando with Florida Smoke Free Association, Keynote Speaker Dimitris Agrafiotis of Tennessee Smoke Free Association, Tony Abboud with Vapor Technology Association (VTA), and Fig Ramsey of Vape Tithing.

Also joining the conference was Jonathan Varner, head of JVA Campaigns (OHVTA’s digital media firm), along with Kevin Boehner and Justin Zink of the Ohio Chamber of Commerce.


This meeting included an active power-bank of knowledge with insightful points of view, experience and education across the day-long conference with members from Florida to California. Industry guests spoke about current issues including lobbying, underage sales and proactively navigating the ever-changing landscape and future.

Changing The Conversation

OHVTA is changing the conversation with lawmakers.

Representative Green and Senator Eklund spoke to the group with sincerity about issues and answered questions. One question was about the best way to go about contacting them, and the answer was clear: email or phone calls. Their staffers take each call and relay it to them.

They want to hear from consumers and businesses, and – we were told, oftentimes lawmakers don’t hear anything about issues they’re voting on, so your call or email could change the mind of your lawmaker.


In Ohio, trying to define vaping products as tobacco and restricting adult access (Tobacco 21) is another concern to adults as another attendee, Lindsey Stroud (below) points out here.

If you told me 6 years ago when I switched that I’d be sitting in Columbus, Ohio for an event like this – I’d have called you insane.

Instead, I was honored to be invited to an industry event, attending this meeting with the perspective of a concerned consumer, much like when I attended “A Billion Lives“. With great concern.

Witnessing what I did, I discovered heroes with one common goal. What I experienced was listening to actively engaged members (and leaders) in this industry who are passionate about their business, their customers, and attain their goal: To help smokers choose a safer alternative. To educate lawmakers. To educate consumers.

Notably, these professionals are proactive about keeping those products out of hands of underage youth. Furthermore, those same people are concerned about politicians trying to take their livelihood, and your choice away from them, and you.

If Ohio is an example of how trade organizations represent the industry, I’m impressed. These people are part of the solution. These folks have a network and discuss experience with local, state and national issues with each other. Engaging. Inspiring. Proactive.

I left this meeting with a renewed sense of hope from these business leaders fighting for consumers who have switched and those who may choose to switch, despite government resistance for the choice to do so.


If you are a consumer, join CASAA. Be engaged. If you’re in business and you haven’t, BE ENGAGED. Join an industry group. I don’t care who you choose, but choose. Conduct yourself as if your life and lives around you, and your business(es) depends upon it. If you don’t, who will?

Vaping Industry Trade Associations

You are one person, don’t you have enough to do already? How many hats can you wear in one day? With a trade association, you are many being represented as a collaboration of many with one loud voice.


Are you louder?

Well funded and oiled organizations are already so loud, I’m barely able to hear you over the noise. They have friends at the local, state and national levels. They have political influence across the country. They have allies and long-standing relationships. They aren’t questioned about their motive. They have immediate credibility just by saying their names.

Other non-profit associations (Tobacco-Free Kids, Truth Initiative, American Heart, Lung, Cancer, American Medical Association, etc.) have already and are still designing and passing tobacco 21 laws, regulations, restrictions, taxes, and bans to put you out of business. It’s like cutting cookies. Wash, rinse, repeat. They’re organized.

They’re doing it – and getting away with it – right in front of you. They’ve already defined your product as a “tobacco product”. The rest is easy for them. While they regulate, restrict, tax and ban less smoking, the rest of your time in business – at the moment – is just a polite formality until you are gone.


You are in business, right?

State and national trade associations are designed to be a resource for professionals to keep up with YOUR industry news, legislative and regulatory alerts, trends, public affairs and education regarding YOUR business.

A trade association should be an invaluable resource for business owners to learn, share, and teach key information with other business owners about things they commonly need like insurance and credit card processing.

Also, they can provide information on issues like compliance, OSHA and industry standards, operating procedures, (carding, transporting, material, battery and chemical handling, clean rooms, etc), protocol and general business practices, they also should be involved with you at the local, state and national level communicating with lawmakers, and creating and maintaining a favorable public image for your industry.

They also likely maintain relationships with other trade associations and suppliers relating to your industry.


Trade Associations

All over the United States, from gumball machines to taxicabs, hairstylists and grocers to various forms of manufacturing and service industries, trade associations are a way for businesses to (here’s a short list) exist and thrive.

Lots of hats to wear

As a former business co-owner, I was a member of the “Taxicab, Limousine & Paratransit Foundation” (TLPF). Why? Because I was a dispatcher, driver, mechanic, lawn boy, car wash guy, human resources, ceiling tile counter, janitor, night watchman, city ordinance liaison, public relations manager, plumber, and vice-president – and I just didn’t have time to know every single bill front and back coming down the pike.

Did you know?

Did you know taxicab drivers are exempt from overtime under the Fair Labor Standards Act (FSLA)? I did. At one time, some taxicab businesses were exempt from gas taxes. From seat belt laws to overtime, I understood the groundwork laid decades before I was in that industry, and why. The state and national trade associations were instrumental in keeping it that way.


Think about gumballs

Why would gumball machine owners need a trade group? Here’s an example that started a trade association group – from the 1950’s:

“In 1950, the United States Treasury Department attempted to impose gambling excise taxes on bulk vendors on the grounds that there was no way for consumers to know for sure which gumball or other product the machine would dispense. For a short time, manufacturers installed viewfinders in bulk vending machines to display the next item to be vended.”

“Vendors organized to found the National Bulk Vendors Association (NBVA), which successfully lobbied against the taxes, arguing that the items vended were of approximate or equivalent value. The NBVA has since lobbied on behalf of bulk vendors on a variety of issues; for instance, it joined the Coin Coalition which pushed for elimination of the U.S. one dollar bill in favor of the United States dollar coin.” (Source).



Do your part – or not

Keeping irresponsible laws and taxes out of politicians hands is YOUR job as a business. With taxes comes higher prices passed on to the consumer. If YOUR customers, consumers like me, are willing to pay higher prices, you’ll be fine. If they can find your product or service reasonably priced, you have a customer. Without customers, you are out of business.

Industry trade groups are designed for businesses. What should your customers know? Consumer groups are designed for consumers. They pass on calls to action and information to help YOU as well as them. You, as a business, should be supporting them as well by telling your customers about those consumer groups along with regulations, restrictions, taxes, and bans coming in your state.

You don’t have much time left. If you’re doing what I, as a consumer, expect you to do as a business owner, thank you. I wish you many years of success. If you’re not, I imagine your customers can find out once they discover your shop has closed.

Vaping: Let’s Get This Out Of The Way

VAPING: “Let’s get this out of the way for 2019”.

In a recent post, James Jarvis discussed common myths about vaping, stating “Let’s get this out of the way for 2019.”

Not only is James Jarvis is President of Ohio Vapor Trade Association (OHVTA), he’s also a consumer. I’ve been to Columbus a couple times to see him, and I’ll describe James simply as good people. He cares about smokers having proper information and he cares about the industry.

To the point, a post on his Facebook page got me to thinking… if some vapers genuinely don’t know or are confused about information, how can the public know?

Let’s change that. Now. Let’s get this out of the way: Educators and legislators must learn.


On Public Record.

With the battle preconceived and one-sided (predetermined in some instances) for power and funding, authorities having jurisdiction (AHJ) of their respective township, town, city, and state must be made aware of all sides of this issue in their communities.

If an opportunity arises for three minutes at a podium, this can be read, memorized – as is – or modified, printed to dispel myths about vaping products and nicotine.

Politely – and directly engaging each concern immediately in front of decision-makers, with proper sources for authorities given the task of deciding the fate of (your) regulations, restrictions, taxes, and bans shows a proactive approach to their concerns no matter what the opposition.

I saw his list and was inspired. I have provided his points about vaping (numbered) from his post and link(s) to each point made.

Let’s get this out of the way

1. Popcorn Lung is not caused from vapor products

From Dr Farsalinos, Brad Rodu, Dr. Siegel and more, a collection of evidence to the contrary:

2. E-Liquid does not contain tobacco

(some liquids do contain nicotine which is extracted from the tobacco plant. It can also be synthetic)

3. Nicotine is classified by the FDA just like caffeine

53% of medical professionals say it’s like caffeine, and only 4 percent said it was “dangerous”.

Ironic, the FDA has removed the link stating

The changes being recommended by FDA include a removal of the warning that consumers should not use an NRT product if they are still smoking, chewing tobacco, using snuff or any other product that contains nicotine—including another NRT.”

4. Tomato, Eggplant, and all nightshade veggies contain nicotine

“Nicotine is an alkaloid found in the nightshade family of plants (Solanaceae), predominantly in tobacco, and in lower quantities in tomato, potato, eggplant (aubergine), and green pepper. Nicotine alkaloids are also found in the leaves of the coca plant.”

Nicotine is also found in tea.

5. Nicotine DOES NOT cause cancer.

What medical ‘experts’ hide: Nicotine does NOT cause cancer

Nicotine has no association with cancer. There is no supportable evidence to link nicotine with cancer, and a vast amount of evidence (and irrefutable facts) that there is no such link.

6. Vape Shops DO NOT want youth to use vapor products, which is why we ID and refuse service

“all vape shops inspected were found to be in compliance”


7. The nicotine used in patches, gums and lozenges is the same as whats used in vapor….

( why is vapor more dangerous???)

It’s the same nicotine.

“Nicotine can also be purchased in many other forms including patches, chewing gum, and liquid extract formula.” That’s here.


8. Vapor is at least 95% – 99% safer than combustible tobacco

According to the Royal College of Physicians and Public Health England:

9. Vapor is NOT a gateway to tobacco.

1.7 Million High Schoolers Vaped in 2016, As Both Vaping and Smoking Declined

Smoking among teens is at their lowest ever, showing 7.60% “monthly use”, 3.6% “daily use“.


10. Vapor is the consumer created solution to the tobacco problem.

11. While youth use of the product Juul has risen, It is far from epidemic proportions. What is a youth epidemic you ask? Alcohol, Opioids and other drugs.

Marijuana = 22.20% “past month”

Illicit Drugs = 24.00% “past month”.

Vaping (any) = 26.70% “past month”

Alcohol = 30.20% “past month”

12. Tobacco 21

A movement in the United States is raising the age of sale of tobacco to 21. While valiant in effort, it both restricts 18-year-old adults from products (e-cigs, snus, etc.) that can help them quit smoking and shows little progress to reduce smoking rates.

The Consumer Advocates for Smoke Free Alternatives Association (CASAA) released this statement about “Tobacco 21” laws:

CASAA Tobacco 21 policy statement: “Including low-risk alternatives in T21 laws is unwise, misleading”

There’s lack of enforcement

As Senator Steve Linthicum (R – Oregon) puts it,

 “freedom from responsibility” will enable more state intervention for many years to come.

Smoking age law simply more nanny state

Tobacco 21 laws enacted are showing smoking increases with laws that includ vapor products.

Electronic Cigarette Age Restrictions May Drive Teens to Traditional Cigarettes

Here, a study showed “Increasing the minimum legal purchase age  (MLPA) to 21 years in NYC did not accelerate reductions in youth tobacco use any more rapidly than declines observed in comparison sites.”

Brad Rodu discusses the Synar Amendment:

“Beginning in 1997, Washington required states to report underage sales via the Synar Program (here).  The latest Synar data shows that 9.6% of retailers were noncompliant in 2013.  The FDA also conducts compliance checks of tobacco retailers.  In 2016, the FDA reported a noncompliance rate of 11% (here).  The FDA should focus on this far more dangerous illegal cigarette sales issue, rather than obsessing over e-cigarettes. “

13. Withholding information:

Being restricted by law (I’m not as a consumer) is not an easy task for shops to contend with. Shops cannot say e-cigarettes could help ‘quit smoking’, or they’re safer than…

“We argue that omitting key health relevant information for current or prospective consumers represents a kind of quarantine of health-relevant information”

14. Nicotine “addiction”

Ignored since 2011, Hanan Frenk and Reuven Dar submitted this to the Harm Reduction Journal:

“We show that the nicotine addiction model presented in this chapter, which closely resembles its 22 years old predecessor, could only be sustained by systematically ignoring all contradictory evidence.”

If the data contradict the theory, throw out the data: Nicotine addiction in the 2010 report of the Surgeon General

This shows “The effects of nicotine on the brain are similar to those of sugar, salt, exercise, and other harmless substances and events. “There are so many findings that conflict so starkly with the view that nicotine is addictive that it increasingly appears that adhering to the nicotine addiction thesis is only defensible on extra-scientific grounds.”

15. HIGHER nicotine levels are SAFE.

A new study shows higher nicotine levels are safe – “nicotine on its own, outside of tobacco products, has limited addictive potential, and that higher doses are safe and well tolerated

16. Second-hand vapor

From the U.S. Department of Health and Human Services, Centers for Disease Control and Prevention, and the National Institute for Occupational Safety and Health :

“We evaluated concerns about exposure to vaping-related chemicals in a vape shop. Exposure to flavoring chemicals (diacetyl, 2,3-pentanedione, acetaldehyde), formaldehyde, nicotine, and propylene glycol were all below occupational exposure limits.”

17. Anti -Freeze

It is not anti-freeze. Simply absurd. As of the publishing of this post, the well respected American Academy of Pediatrics is still eluding to ‘anti-freeze’ as an ingredient on their ‘quick facts’ section here.
