It seems you can, they may, might or could, but will choose to enforce certain things. At their discretion, FDA does not intend to enforce those requirements. Discretionary enforcement? Makes sense, right?

According to the Office of San Francisco City Attorney, Dennis J. Herrera, cigarettes are “appropriate for public health” in San Francisco, vaping products are not. Here’s his tweet:

Speaking of banning less harmful alternatives, and the reference the SF attorney used, Puff-N-Stuff thinks it’s a smart move. He also explains the FDA “exercised what is called enforcement discretion”.
